招徠
SOLICITATION
Solicitation is forbidden under the ABA rules. A solicitation is a targeted communication initiated by the lawyer that is directed to a specific person that lawyer knows or reasonably should know needs legal services in a particular matter, and that directly or indirectly offers to provide legal service in that matter.
招徠是ABA規(guī)則所禁止的。招徠是指律師在知道或者應(yīng)當(dāng)知道特定的人就某一特定事項(xiàng)需要法律服務(wù)，由律師向特定人發(fā)起的有目的的交流，旨在直接或間接要求就該事項(xiàng)提供法律服務(wù)。
A lawyer must not solicit professional employment by in-person, live telephone, or other real-time visual or auditory person-to-person communications with a significant motive to obtain pecuniary gain, but is not prohibited from sending truthful, nondeceptive communications, such as via mail, e-mail, or recorded telephone messages, to persons. The purpose is to protect the targeted person from being subjected to a direct personal encounter without time for reflection.
律師禁止以獲取金錢收益為目的，通過(guò)當(dāng)面、電話或其他即時(shí)視聽(tīng)一對(duì)一交流的方式，招徠生意。但允許通過(guò)向特定人發(fā)送真實(shí)的溝通，例如通過(guò)信件、郵件或可被記錄的電話留言。目的旨在保護(hù)特定人不因直接的個(gè)人交鋒而沒(méi)有時(shí)間反應(yīng)。
To the following people, a lawyer is not prohibited from initiating personal contact:
? another lawyer
? a person with whom the lawyer has a familial, close personal, or prior professional relationship
? a person who routinely uses for business purpose the type of legal services offered by the lawyer
但是對(duì)于以下人群，律師是可以發(fā)起個(gè)人接觸的：其他律師；與該律師有家庭的，親密的關(guān)系的或者之前職業(yè)關(guān)系的人；基于商業(yè)目的常規(guī)性接受律師提供的某類法律服務(wù)的人。
